Informace ke zpracování osobních dat
Společnost KULTURUS z.s., se sídlem: Sezimova 481/15, 140 00 Praha – Nusle, IČO: 04108019, dbá na ochranu osobních údajů, které nám předáváte. Osobní údaje, které nám poskytujete, zpracováváme maximálně zodpovědně a zcela transparentně a máte nárok požádat o informace o námi evidovaných osobních údajích, jejich opravu, či výmaz, pokud jsou uděleny na základě Vámi vysloveného souhlasu. V případě jakýchkoli dotazů týkající se zpracování Vašich osobních údajů se na nás můžete obrátit písemně na adrese sídla společnosti nebo se obrátit přímo na níže uvedeného pověřence pro ochranu osobních údajů.
Zpracování osobních údajů
Společnost KULTURUS z.s., zpracovává osobní údaje výhradně na základě důvodů stanovených v aplikovatelných právních předpisech. Pro zpracování osobních údajů musí být naplněn alespoň jeden ze zákonných důvodů, kterými jsou: souhlas se zpracováním osobních údajů, nebo plnění smluvních závazků, plnění právní povinnosti správce, oprávněné zájmy správce.
Společnost KULTURUS z.s., zpracovává následující osobní údaje:
identifikační údaje, kterými se rozumí zejména jméno a příjmení, uživatelské jméno a heslo, datum narození, příslušnost a rodné číslo;
kontaktní údaje, jimiž se rozumí osobní údaje, které nám umožňují kontakt s vámi, zejména e – mailová adresa, telefonní číslo, adresa bydliště a váš kontakt na sociálních sítích;
**vaše nastavení, kterými se rozumí údaje ve vašem účtu, zejména uložená adresa a nastavení newsletterů;
údaje o vašem zdravotním stavu, kterými jsou zejména informace o zdravotním omezení souvisejícím s využíváním naších služeb, jako je zdravotní hendikep či těhotenství;
**údaje z vašeho hodnocení námi nabízených služeb, kterými se rozumí informace, které uvedete v recenzi poskytnutých služeb na našem webu a vaše fotografie, které k recenzi připojíte;
odvozené údaje, kterými se rozumí osobní údaje odvozené z vašeho nastavení, údajů o službách, které u nás objednáváte, údajů o vašem chování na webu a údajů o vašem chování při čtení zpráv, které vám zasíláme; zejména se jedná o údaje o vašem pohlaví, věku, chování a vztahu k různým službám;
**údaje související s využitím call centra nebo návštěvou naší provozovny kterými jsou zejména záznamy telefonních hovorů s call centrem, identifikace zpráv, které nám zasíláte, vč. identifikátorů, jako jsou IP adresy, a nahrávky z kamerových systémů na našich provozovnách
Jaká zpracování můžeme provádět bez vašeho souhlasu, závisí na tom, k jakému účelu příslušné zpracování směřuje a v jaké pozici vůči nám vystupujete – zda jste jen návštěvníkem našeho webu, nebo se u nás zaregistrujete či vytvoříte objednávku.
Vaše údaje můžeme také zpracovávat, pokud pokud s námi komunikujete nebo pokud navštívíte naši provozovnu.
1. Pokud navštívíte náš web
1.1 Využívání souborů cookies a dalších technologií
Pokud navštívíte náš web, do vašeho zařízení ukládáme a následně z něj čteme malé soubory jako cookies. Cookie je malý soubor písmen a čísel, který ukládáme ve vašem internetovém prohlížeči nebo pevném disku vašeho počítače. Některé cookies nám umožňují propojit vaše aktivity během prohlížení našich stránek od chvíle, kdy otevřete okno webového prohlížeče, do okamžiku, kdy jej zavřete. Ve chvíli, kdy zavřete okno internetového prohlížeče, se tyto cookies vymažou. Jiné zůstávají v zařízení po nastavenou dobu a aktivují se pokaždé, když navštívíte webovou stránku, která konkrétní cookie vytvořila. Dále používáme pixelové značky (také známé jako web beacons), což jsou malé obrázky, které mají podobnou funkci jako cookies. Oproti cookies, které jsou ukládány na pevném disku vašeho počítače, jsou pixelové značky pevnou součástí webových stránek. O všech těchto technologiích budeme pro zjednodušení v tomto dokumentu dále mluvit jako o cookies. Cookies do vašeho zařízení nejen ukládáme, ale také čteme ty cookies, které do vašeho zařízení uložil náš web. Dále v tomto dokumentu budeme pro jednoduchost mluvit pouze o ukládání.
Některé cookies do vašeho zařízení ukládá přímo náš web. Tyto cookies nám pomáhají:
• identifikovat vás při přecházení mezi jednotlivými stránkami našeho webu a při opětovných návštěvách, například abychom si mohli zapamatovat vaše přihlášení z konkrétního zařízení a nežádat vás opakovaně o e-mail a heslo, nebo abychom si uložili, kterou verzi našeho webu vám máme zobrazit, pokud web nabízí v danou chvíli více variant;
• zaznamenat si, že jste nám udělili souhlas dle tohoto dokumentu, popř. zda jste např. nabídli účast v určitém průzkumu;
• se zajištěním bezpečnosti, například abychom zkoumali, zda někdo nezneužil vaše připojení k našim webovým stránkám a nejedná místo vás;
• evidovat, zkoumat a odstraňovat poruchy a nefunkční součásti našich webových stránek.
• sledovat návštěvnost našeho webu, jeho jednotlivých stránek, vytvářet statistiky a přehledy a měřit účinnost reklamy;
• zobrazovat vám různé varianty našich webových stránek, pokud testujeme nové funkcionality;
Takové cookies a další soubory jsou nezbytné pro fungování naší webové stránky. Pokud ve svém prohlížeči zablokujete tyto cookies, naše webová stránka nemusí fungovat správně a my vám nemusíme být schopní poskytovat naše produkty a služby.
Dále do vašeho zařízení:
• ukládáme cookies z našeho webu, které nám umožňují:
• přizpůsobovat pro vás obsah našeho webu, například vám zobrazit přednostně produkty, které jste si již prohlédli, a zobrazovat vám další nabídky na míru na našem webu;

Využívání osobních údajů návštěvníků webu
Pokud navštívíte naše webové stránky, zpracováváme údaje o vašem chování na webu na základě našeho oprávněného zájmu (tedy bez vašeho souhlasu) za účelem:
• získání informací, na základě kterých pro vás budeme moci web v budoucnu vylepšit; naším oprávněným zájmem je zde zlepšování našich služeb pro vás;
• vytváření statistik a přehledů, zejména sledování návštěvnosti našeho webu, jeho jednotlivých stránek a měření účinnosti reklamy; naším oprávněným zájmem je zde měření efektivity našeho webu a výdajů na reklamu; pro tento účel můžeme z vašeho chování na webu získávat další odvozené údaje a k tomuto účelu je použít;
• testování nových funkcí a aplikací před nasazením, zejména abychom předešli problémů s funkčností těchto novinek ve skutečném provozu, které by mohly zhoršit váš zážitek u nás; naším oprávněným zájmem je zde bezproblémová funkčnost našich služeb pro vás;
• předcházení útoků na náš web a ohrožení jeho funkčnosti i bezpečnosti vašich dat; naším oprávněným zájmem je zde bezproblémová funkčnost našich služeb pro vás a bezpečnost vašich dat. Údaje o vašem chování na webu nezískáváme pouze z cookies. Doplňujeme je také o údaje:
• IP adresa vašeho zařízení (adresa vašeho zařízení, pomocí které komunikujete s jinými zařízeními v síti internet);
• operační systém vašeho zařízení, jeho verze a jazykové nastavení;
• prohlížeč, který na svém zařízení používáte, jeho verze a jazykové nastavení;
• adresa webové stránky (URL adresa), ze které přicházíte na náš web.
Pro tyto účely osobní údaje používáme po dobu nejvýše 24 měsíců. Proti tomuto zpracování máte právo uplatnit námitku.
Údaje o vašem chování na webu také zpracováváme na základě Vašeho souhlasu uděleného při registraci Vašeho účtu nebo předání Vašich osobních údaje při provedení rezervace služeb. Naším oprávněným zájmem je zde maximálně personalizovaná a efektivní nabídka pro vás. Jmenované údaje pro tento účel také obohacujeme pomocí analýzy a získáváme z nich odvozené údaje. Podle těchto údajů také rozčleňujeme naše uživatele do různých skupin, kdy každá skupina obdrží vlastní specifickou nabídku. Pokud u nás následně budete něco objednávat, využíváme pro tyto účely navíc údaje o vašich objednávkách.
Pokud jste si tedy na našem webu prohlédli nabídku služby, tuto službu vám můžeme při příští návštěvě zobrazit na první stránce našeho webu. Podle toho, jakou službu jste si prohlédli, můžeme také usoudit, do jaké skupiny zákazníků patříte, a podle toho vám na webu nabídnout další služby, které by vás podle našeho posouzení mohly zajímat.
Pro tyto účely osobní údaje používáme po dobu 2 let.
2. Pokud se u nás zaregistrujete
Abyste se mohli zaregistrovat, musíte navštívit náš web, proto se vás týkají zpracování popsaná v části „Pokud navštívíte náš web“. V případě, že se zaregistrujete, pak navíc provádíme následující zpracování:
2.1. Zpracování na základě plnění smlouvy
Pokud si vytvoříte účet na našich webových stránkách, zpracováváme vaše identifikační a kontaktní údaje, vaše nastavení a údaje o vašich objednávkách (pokud u nás později objednáte nějakou službu), na základě plnění smlouvy s vámi (bez vašeho souhlasu), abychom mohli vést váš uživatelský účet. Smlouva, o kterou se naše zpracování opírá, vzniká vytvořením vašeho účtu.
Pro tento účel osobní údaje používáme po dobu existence vašeho účtu. Za výjimkou, kdy musíme vaše údaje zpracovávat a chránit podle zákonu.
2.2. Zpracování na základě oprávněného zájmu
Pokud si vytvoříte účet na našich webových stránkách zpracováváme vaše identifikační a kontaktní údaje, vaše nastavení, údaje o vašich objednávkách (pokud u nás později objednáte nějakou službu) a údaje o vašem chování na webu a chování při čtení zpráv na základě Vámi uděleného souhlasu, a to za účelem:
• získání informací, na základě kterých pro vás budeme moci naše služby v budoucnu vylepšit, zejména zjišťování vaší spokojenosti s našimi službami; naším oprávněným zájmem je zde zlepšování našich služeb pro vás a
**• poskytováním nabídek na míru a cílené reklamy, kterou vám můžeme zaslat e-mailem, textovou zprávou, pomocí sociálních sítí, sdělit je po telefonu nebo jinými elektronickými prostředky, zaslat vám je poštou nebo zobrazit na našem webu; tyto nabídky se mohou týkat jak našich produktů a služeb, tak produktů a služeb třetích stran; naším oprávněným zájmem je zde efektivní propagace našich produktů a služeb.
Abychom vám mohli nabídku na míru připravit, výše uvedené údaje analyzujeme a získáváme z nich další odvozené údaje, které pro tento účel používáme. Takto můžeme použít rovněž údaje o vašem chování na webu, které jsme získali před tím, než jste se zaregistrovali, a můžeme sbírat údaje o vašem chování na webu i když se nepřihlásíte (např. když vás identifikujeme pomocí cookie). Podle těchto údajů také rozčleňujeme naše uživatele do různých skupin, kdy každá skupina obdrží vlastní specifickou nabídku.
Na základě našeho oprávněného zájmu (tedy bez vašeho souhlasu) také použijeme vaše nastavení pro testování nových funkcí a aplikací před nasazením, jak je popsáno v části „Pokud navštívíte náš web“.
Pro tyto účely osobní údaje používáme po dobu existence vašeho účtu. Proti těmto zpracováním máte právo uplatnit námitku.
2.3. Processing based on consent
If you create a review within your account on our website, we process your identification data and data from your evaluation of the services offered by us, including embedded photos, also based on your consent to the processing, for the purpose of sharing information about your satisfaction with the services offered with other visitors to our website. We use personal data for this purpose until you withdraw your consent to processing.
3. If you create an order with us
If you create an order (or request) on our website, the processing described in the section "If you visit our website" applies to you. If you place an order with us, we also perform the following processing:
3.1 Processing based on contract performance
If you place an order with us as a natural person, we process your personal data for the purpose of processing your order, your identification and contact details and your order details.
If you purchase from us as a representative of a legal entity, we process the same data for the same purpose based on our legitimate interest in concluding and fulfilling a contract with the person you represent.
The fact that we use this data for the purpose of processing your order means that we use it in particular:
• so that you can complete your order on the website, for example, so that the data from the order in progress is not deleted;
• to communicate with you about your order, for example to send you a confirmation of your order;
• in connection with securing and claiming the ordered service; in this context, we may also transfer your data to a service provider as described in Who processes your personal data and to whom do we transfer it?;
• in connection with your other requests, which you contact us with, for example, using the call center, as described in the section "If you communicate with us through different channels".
For this purpose, we use personal data for the time necessary to process your order, or settlement of a contractual claim, such as a complaint.
3.2 Processing based on legitimate interest
If you place a binding order with us, we will retain your identification and contact details and your order details based on our legitimate interest (without your consent) for the purpose of protecting legal claims and our internal records and controls. Our legitimate interests here are the protection of legal claims and the control of the proper provision of our services. In this context, we may also process your biometric data for this purpose on the basis of necessity for the protection of our legal claims, if you sign a contract with us at our premises.
In the case of creating an order, we further process your identification and contact data (if you have an account with us) and data about your orders on the basis of our legitimate interest (i.e. without your consent) for the purpose of:
• obtaining information on the basis of which we can improve our services for you in the future, in particular determining your satisfaction with our services; our legitimate interest here is to improve our services to you and
• providing you with tailored offers and targeted advertising that we may send to you by email, text message, social media, telephone or other electronic means, or mailed to you; our legitimate interest here is the effective promotion of our services. In order to be able to prepare a tailor-made offer for you, we analyze the above data (i.e. your identification and contact data and data about your orders) and obtain additional derived data from them, which we use for this purpose. According to this data, we also divide our users into different groups, with each group receiving its own specific offer. If you do not register with us, we do not use data about your behavior on the website to prepare the offers with which we address you.
Therefore, if you have ordered a service from us, we can contact you with a targeted offer of related services. From your order, we can also infer which customer group you belong to and send you an offer for related services that may be of interest to you. If you do not have an account with us, we will not customize offers based on which services you have viewed on our website or which links you have opened in the offers sent to you.
In order to protect legal claims and our internal records and control, we process data for the duration of the limitation period (3 years) and one year after its expiration with respect to claims made at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination.
For the other stated purposes, we use personal data for a period of 3 years from the placing of the order.
You have the right to object to this processing carried out on the basis of our legitimate interest.
3.3 Processing based on the fulfillment of legal obligations
We also have to fulfill certain statutory obligations. If we process your personal data for this very reason, we do not need to obtain your consent for such processing. On this legal basis, we process your identification and contact data, order data, in order to comply with the following laws in particular:
• Act No. 89/2012 Coll., Civil Code,
• Act No. 634/1992 Coll., on consumer protection,
• Act No. 235/2004 Coll., on value added tax,
• Act No. 563/1991 Coll., on accounting.
We use personal data for these purposes for 10 years.
3.4 Processing based on consent
If you give us your consent when ordering the service, we may also process:
• your health information so that we can record your health limitations and ensure that these limitations are respected in the provision of our services; such consent by you must be express;
• your social security number for the purposes of your identification in cases where it is necessary; in such cases, we cannot provide you with such an order without your consent to the processing of the social security number;
We process this data for the time necessary to process your order, or processing a contractual request, such as a complaint, or until you revoke your consent. In selected cases, we may retain your data even after withdrawal of consent, if this is necessary to protect our legal claims. We will then retain this data for the period described above in the section Processing based on legitimate interest.
4. If you communicate with us through different channels
If you communicate with us through various channels, in particular through the call center, e-mail, chat tools and social networks, we will process your identification and contact data and records of the communication that took place on the basis of our legitimate interest (ie without your consent) in order to:
4.1. processing your requests; if you have created an order with us and your request relates to the order, we can implement this processing based on the performance of the contract with you;
4.2. records of your requests so that we can check that we fulfill them properly and on time;
4.3. proving that we have accepted and dealt with your request, e.g. when you order something from us in this way or make a complaint;
4.4. their analysis to improve the quality of our services.
For these purposes, we keep personal data for a period of 1 year from the end of the provision of services mediated by us. You have the right to object to processing based on our legitimate interest.
5. If you subscribe to our newsletter
If you subscribe to our newsletter, we will process your contact information or your settings based on your consent to the processing for the purpose of sending our offers. We use personal data for this purpose until you withdraw your consent to processing, i.e. until you unsubscribe from the newsletter.
FROM WHAT SOURCES DO WE OBTAIN PERSONAL DATA?
In most cases, we process personal data that you provide to us as part of ordering services, creating and using an account, or when communicating with us, for example at the call center. We also collect personal data directly from you by monitoring your behavior on our website and when you read messages. We may also receive your personal data from a third party, for example when they order a service for you from us.
Security of your personal data
The company KULTURUS zs. takes care of the security of the personal data that you pass on to us. We have taken appropriate technical and organizational measures to adequately protect your data, taking into account the seriousness of their processing. No unauthorized person has access to your personal data that we have obtained from you, and we do not transfer it to other entities for further processing without your consent, unless required by law or legitimate protection of our legal interests. Who processes your personal data and to whom do we pass it on?
In the cases described in the section Why do we process personal data and what authorizes us to do so? we process your personal data as the controller. This means that we determine the above-defined purposes for which we collect your personal data, determine the means of processing and are responsible for their proper execution.
We may also transfer your personal data to other entities that are in the role of administrator, namely:
• in connection with processing your order to our partners who participate in this fulfillment, as stated in the section If you order something from us
• based on your consent to advertising and social networks, as described in the section Use of cookies and other technologies, transfer of data to advertising and social networks, namely:

** For the processing of personal data, we also use the services of other processors who process personal data only according to our instructions and for the purposes described in the section Why do we process personal data and what authorizes us to do so? Such processors are:
1. cloud service providers and other technology and support suppliers such as Microsoft and Google;
2. operators of marketing tools such as Google as part of Google Analytics and HotJar (HotJar Ltd, with registered office at 3 Elia Zammit Street, St. Julians STJ 1000, Malta) who help us optimize the website and personalize content and offers for you;
3. operators of marketing tools, such as Google within the Google Adwords service, who help us personalize content and offers for you;
4. operators of marketing tools, such as List within the Sklik service, who help us personalize content and offers for you
In some cases, we also process your personal data as a processor if:
1. we conclude a contract with you on behalf of you or handle a complaint with you;
Right to information
It is your right to ask KULTURUS zs for information about what personal data and to what extent and for what purpose we process it, who processes it outside of us and what other rights you have related to the processing of your personal data. You can find out all this in this document "Customer privacy protection". However, if you are not sure which personal data we are processing about you, you can ask us to confirm whether or not personal data relating to you is being processed by us and, if so, you have the right to access that personal data . As part of the right of access, you can ask us for a copy of the processed personal data, whereby we will provide you with the first copy free of charge and additional copies for a fee within 30 days at the latest, and in exceptional situations within 90 days at the latest. We will inform you in time about the extension of the deadline in exceptional cases. If you request the communication of the information we record about you, we will first need to verify that you are really the person to whom this information belongs. Please provide sufficient identification of your person in your application. If necessary, we have the right to request additional information for your identification before we provide you with the personal data that we process about you.
We then have the right to reject requests for information that are unreasonable, unreasonably repeated, or require unreasonable effort to obtain them, or would be difficult to obtain (typically from backup systems, archives, etc.).
Update of data, right to rectification
Since personal data can change over time (for example, a change of surname), we would be happy if you inform us that there has been a change, so that we have your personal data up-to-date and avoid possible mistakes. Submitting information about data changes is absolutely necessary so that we can properly perform our activities as an administrator.
Related to this is your right to correct the personal data we record about you. If you find that our data is no longer up-to-date, you have the right to request its correction.
Right to restriction of processing
• In some cases, in addition to the right to erasure, you can use the right to limit the processing of personal data. This right allows you to request in certain cases that your personal data is marked and that these data are not the subject of any further processing operations - in this case, not forever (as in the case of the right to erasure), but for a limited period of time. We must limit the processing of personal data when:
• you dispute the accuracy of personal data before we agree what data is correct;
• we process your personal data without a sufficient legal basis (e.g. beyond what we have to process), but you will only prefer to limit such data before deleting it (e.g. if you expect to provide us with such data anyway in the future);
• we no longer need your personal data for the above processing purposes, but you require it for the determination, exercise or defense of your legal claims, or
• you object to the processing. The right to object is described in more detail below in the chapter Right to object to processing). For the period during which we save, if your objection is justified, we are obliged to limit the processing of your personal data.
Right to portability
You have the right to receive from us all your personal data that you yourself have provided to us and that we process based on your consent and based on the performance of the contract. We will provide you with your personal data in a structured, commonly used and machine-readable format. In order to be able to easily transfer the data at your request, it can only be data that we process automatically in our electronic databases.
Objections
If you believe that we are not processing your personal data in accordance with the applicable legislation of the Czech Republic and the European Union, you have the right to raise an objection and we will subsequently check the legitimacy of your request. We inform you that you also have the right to object to the processed personal data that we process about you to the relevant supervisory authority for the protection of personal data at the address:

Right to erasure
If you have ever given us consent to the processing of your personal data, you have the right to revoke it at any time and we are obliged to delete the personal data that we process solely on the basis of your consent. The right to erasure does not apply to processed data within the framework of the obligation to fulfill the contract, legal reasons or legitimate interests. If some of your data is stored in backup systems that automatically ensure the resilience of all our systems and perform the function of data loss protection in case of accidents, it is not within our power to delete this data even from the backup systems, and often it is not even technically feasible. However, this data is not further actively processed and will not be used for other processing purposes.
In some cases, you have the right to have your personal data deleted. In order to submit this application, it is necessary that it be submitted in a way that allows accurate identification of the applicant. We will delete your personal data without undue delay if any of the following reasons are met:
• we no longer need your personal data for the purposes for which we processed them;
• you revoke your consent to the processing of personal data, in the case of data for which your consent is necessary for processing and at the same time we have no other reason why we need to continue processing this data;
• you exercise your right to object to processing (see the Right to object to processing section below) for personal data that we process on the basis of our legitimate interests and we find that we no longer have such legitimate interests that would justify such processing, or
• you believe that the processing of personal data carried out by us is no longer in accordance with generally binding regulations.
But please keep in mind that even if it's one of these reasons, it doesn't mean we'll delete all your personal data right away.
